(Certificate holders are encouraged to allow the use of empty seats to accommodate CRS however, they are not required to allow unticketed children to occupy empty passenger seats, even if the child uses a CRS.) This means, if your car seat is FAA-approved, they MUST allow you to use it. Under the provisions in parts 121, 125, and 135, no certificate holder may prohibit a child from using an approved CRS when the parent/guardian purchases a ticket for the child. It does not mean that the CRS must be forward-facing. It means that the CRS (Child Restraint System, aka car seat) is to be installed in a forward-facing seat. If they are rear-facing in your car, they should be rear-facing on the plane– even if it interferes with the recline of the seat in front of you. You should use your car seat on board the plane the same way you do in a car. If that happens, it’s best to travel with a car seat travel bag that will offer some padding and protect your car seat should you have to gate check it. However, you will end up having to gate check your car seat if you can’t use it.
